This document is an official public offer (proposal) on behalf of “Nobelon” (hereinafter referred to as the “Contractor”) regarding the conclusion of an Agreement on the provision of event organization services, artist engagement, and related services.
Anyone who accepts this Offer becomes a Customer and thereby confirms agreement with all the terms of the Agreement set forth below.
1. GENERAL PROVISIONS
1.1. This Offer regulates the relationship between the Contractor and the Customer regarding the organization of entertainment, children’s, concert, advertising events, engagement of artists, as well as other services provided by the Contractor.
1.2. Publication of the text of this Offer on the website https://nobelon.ua/terms is a proposal to conclude an agreement in accordance with the provisions of Articles 633, 641, and 642 of the Civil Code of Ukraine.
1.3. Acceptance of this Offer is the Customer’s confirmation of service orders through the website, e-mail, messengers, or verbal agreement by phone.
2. SUBJECT OF THE AGREEMENT
2.1. The Contractor undertakes to provide the Customer with services, namely: event organization, selection and engagement of artists, hosts, animators, technical support (sound, lighting, etc.), in accordance with the Order conditions.
2.2. Specific conditions (date, time, place, composition of artists, script, price, etc.) are agreed upon individually with each Customer in oral or written form.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The Contractor Undertakes to:
- Provide services of proper quality in accordance with the agreed conditions.
- Promptly inform about changes in conditions or inability to fulfill obligations.
3.2. The Customer Undertakes to:
- Provide complete and accurate information necessary for the execution of the order.
- Pay for services in a timely manner as agreed.
- Not violate the copyright of artists involved in the event.
4. COST AND PAYMENT PROCEDURE
4.1. The cost of services is determined individually for each order and agreed upon in written or verbal form.
4.2. Payment is made on the terms of advance payment (deposit) or full payment according to the agreed schedule.
4.3. The Contractor has the right not to begin providing services without receiving an advance payment (if this is stipulated by the agreement).
5. LIABILITY OF THE PARTIES
5.1. In case of non-fulfillment or improper fulfillment of obligations, the Parties shall bear responsibility in accordance with the current legislation of Ukraine.
5.2. The Contractor is not responsible for the actions of third parties agreed upon with the Customer (venue landlords, logistics, etc.), as well as for force majeure circumstances.
6. REFUND POLICY
6.1. In case of cancellation of the event at the Customer’s initiative less than 72 hours in advance – the advance payment is non-refundable.
6.2. If it is impossible to provide services due to the Contractor’s fault – the advance payment is subject to full refund.
7. PERSONAL DATA
7.1. By accepting this Offer, the Customer consents to the processing of their personal data in accordance with the Law of Ukraine “On Personal Data Protection”.
7.2. The data is used exclusively for the fulfillment of obligations under this agreement and is not transferred to third parties without permission.
8. OTHER CONDITIONS
8.1. All disputes are resolved through negotiations. If an agreement cannot be reached, the dispute is referred to court in accordance with the current legislation of Ukraine.
8.2. The Contractor reserves the right to make changes to this Offer. The current version is always available at: https://nobelon.ua/terms.
